Please read through these terms and conditions carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read my privacy statement regarding any personal information you may provide.
I reserve the right to modify or withdraw items from my range at any time and without prior notification. There is a 1 metre minimum order length for fabric via my website.
Horizontal patterns are printed and sold with a commercial tolerance for straightness. Although every effort is made to have horizontal designs running true, a commercial tolerance of 2% which equates to 2.8cm across the width of cloth (taking into consideration cloth width is 137cm) is deemed acceptable.
My fabrics are made from natural products and may have natural characteristics such as slubs and other irregularities in the yarns which are not weaving faults and therefore not considered faults by The Painted Room.
Vintage items will have been owned and used by others in the past and will inevitably show signs of wear and will not be pristine. I will however endeavour to draw your attention to any major defects or characterful imperfections.
Bespoke/handmade items made from my fabrics may differ from the stock images on this site as the pattern placement can vary. If you wish to see the finished product prior to dispatch please email me so I can forward some images.
Prices may be subject to change at any time – the current price will be quoted at time of order. Prices are exclusive of duty for international orders. The prices shown for products on the website are exclusive of delivery. The cost of delivery will be added to the total price at check out. More detailed information can be found in the delivery section on the website. Overseas delivery charges will be calculated individually and I can advise directly by email or phone.
Online payment is processed by Stripe – which accepts payment by credit card, debit card and Apple Pay. Should you wish to pay by PayPal you will need to contact me direct so I can arrange to organise and send out a PayPal invoice. Personal cheques and cash on collection are also accepted forms of payment.
When I receive your order, an automated email reply will be sent to you to acknowledge receipt and to confirm the details of your order and payment information. Please note that this confirmation email does not constitute acceptance of your order or a guarantee that the order can be fulfilled. I will contact you directly if I have any queries or if I am unable to fulfil the order. No contract will exist until I have accepted and confirmed your order in writing and the goods have been dispatched and delivered – this represents the time at which a Contract of Sale is made between The Painted Room and you.
My fabrics are digitally printed to order. I aim to process and dispatch orders within 15 working days. I will advise lead time at the time of order if my base fabric cloth is out of stock– this is usually 4-6 weeks from receipt of order. All delivery dates are estimates. Bespoke cushion/lampshade orders will usually be delivered within 10 to 15 working days from receipt of order, if fabric is in stock. I will make every effort to keep you informed of any delays should they arise; however I am not liable for the consequence of any delay. Any delay of part of an order against an estimated delivery date does not entitle you to cancel the order.
AMENDMENTS OR CANCELLATION OF ORDERS
You have the right to cancel your order within 14 working days from the day after receipt of goods as per The Consumer Protection (Distance Selling) Regulations 2000. Notification of cancellation or amendment of your order, once placed, should be made to The Painted Room in writing – I will endeavour to amend orders already in the system, however I cannot amend or cancel a fabric order once the fabric has been cut or dispatched. I am unable to cancel bespoke handmade orders if the product has already gone into production.
I accept returns on products that are damaged in transit, faulty or incorrect, however I am unable to accept returns of partial or cut lengths from your original order. Returns of bespoke products will only be accepted where products are found to be faulty or damaged upon receipt. You are responsible for checking all goods upon receipt of delivery and should notify The Painted Room in writing of any faults or defects within 5 working days of delivery, whereupon I will offer a replacement where possible or refund. I cannot accept responsibility for any discrepancies or faults after this time. The Painted Room is not responsible for return postage other than for incorrect, damaged in transit and faulty items. I strongly advise that you use recorded or special delivery and retain proof of postage for returns, as I am unable to accept responsibility for parcels that fail to reach me.
Returned goods that The Painted Room has acknowledged as faulty, damaged in transit or incorrect will be refunded to you in full, I will also refund the cost of returning the goods to me. Refunds will be made as quickly as possible – I aim for within 5 working days from receipt of returned goods.
All goods are supplied by The Painted Room on the strict condition that my liability for any fault or defect in the quality, condition, description or fitness for any purpose is limited in amount to a sum not exceeding the purchase price of the particular goods. It is your responsibility to check that you have received the correct order before further processing or passing on to a third party.
Every care is taken by me to ensure the consistency of colour across my fabrics, however because I use natural fabrics and fibres, there will be slight variations in the weave and colour from batch to batch. Please ask for a stock sample cuttings before ordering if exact colour matching is required.
Every care has been taken to ensure that the information I have posted on the website is accurate and that all products are accurately and fairly described. All quoted prices for goods and delivery costs are correct at the time of posting, however please note that products and prices are subject to change. I have made every effort to ensure that the colours in the photographs of the product appearing on our website are as near as possible to the colour of the original items.
Colour display varies among computer hardware, therefore printed colour may appear different on your monitor/mobile device. I cannot be held responsible for such discrepancies. If you are concerned about colour matching, please ask for a stock sample cuttings before ordering if exact colour matching is required.
SOCIAL PHOTO SHARING
I welcome you sharing my photos in the appropriate manner, but please ensure that you credit The Painted Room and include a link to my website when you use Facebook, Pinterest, Instagram, Flickr or other photo sharing sites.
The Painted Room is committed to protecting your privacy, and will only use the information that I collect about you lawfully and in accordance with the Data Protection Act, 1998 and associated legislation. I request personal information from you in order to process your order and also to enable me to contact you should any queries regarding you order arise. I will not pass your personal details to any other third party for marketing purposes and I do not have access to your credit card or bank details as this is handled directly by Stripe.
I may occasionally include links to third party websites my site – whilst I make every effort to carefully curate these links, their inclusion does not constitute my recommendation or endorsement of the sites. Furthermore, I do not have control over the content of these sites or their individual privacy policies.
In the event of circumstances falling within the normal meaning of Force Majeure, i.e. any circumstances beyond the reasonable control of The Painted room, including such circumstances affecting The Painted Room’s suppliers, The Painted Room will be relieved of all liabilities caused by such circumstances.
